Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the NerdHouse LLC website at nerdhouse.com and any associated services (the “Site” and “Services”). By using the Site or contacting us through it, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms are between you and NerdHouse LLC, a Hawaii limited liability company (“NerdHouse,” “we,” “us,” or “our”). If you receive professional services from NerdHouse under a separate signed Master Services Agreement, Letter of Engagement, or Statement of Work, the terms of those documents control over these Terms with respect to those services.

1. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site. You must not attempt to gain unauthorized access to any portion of the Site, the systems on which it is hosted, or any related network.

2. Services Overview

NerdHouse provides managed IT, cybersecurity, Microsoft 365, and related advisory services to small businesses. Information on this Site is for general informational purposes and does not constitute a binding offer of services. Any engagement requires a separate written agreement signed by both parties.

3. Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is the property of NerdHouse LLC or its licensors and is protected by U.S. and international copyright and trademark laws. You may view and download content for your own non-commercial reference. You may not republish, redistribute, or create derivative works without our prior written consent.

4. SMS Messaging Terms

By opting in to receive SMS messages from NerdHouse, you agree to the following:

  • You are the account holder of the wireless number you provide, or you have authorization from the account holder to enroll the number.
  • You consent to receive recurring informational and service-related text messages from NerdHouse at the number provided.
  • Message frequency varies; standard message and data rates from your wireless carrier may apply.
  • You may cancel at any time by replying STOP. Reply HELP for help, or contact support@nerdhouse.com.
  • Consent to receive SMS messages is not a condition of purchasing any product or service.
  • NerdHouse will not be liable for delayed or undelivered messages caused by carrier networks or recipient device issues.

5. Third-Party Services & Links

The Site may reference or link to third-party websites and services (e.g., Microsoft, ConnectWise, SentinelOne, Huntress, TD Synnex). NerdHouse is not responsible for the content, privacy practices, or availability of those third parties. Your use of any third-party service is governed by that party’s own terms.

6. Disclaimer of Warranties

The Site and any informational content on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, and non-infringement. NerdHouse does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, in no event will NerdHouse, its members, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from your use of the Site is limited to one hundred U.S. dollars ($100).

Nothing in this section limits liability that cannot be excluded under applicable law.

8. Indemnification

You agree to defend, indemnify, and hold harmless NerdHouse and its members, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

9. Governing Law & Venue

These Terms are governed by the laws of the State of Hawaii, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Honolulu County, Hawaii, and you consent to the personal jurisdiction of those courts.

10. Changes to These Terms

We may update these Terms periodically. Changes are effective when posted, with the updated date shown above. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
